Opening Day

Based solely(only) on what the lawyers said in their opening statements and the testimony of the Constable and Grandma Tuck, do you believe that the prosecution has met the Burden of Proof in their claim of kidnapping? Why or why not, use the notes you took during today's trial to help support your answer.

  2. No because this is only the beginning of the trial so we do not know anything yet. Also today during the trial we only asked two witnesses questions and we still have more to go before the trial ends. So the prosecution lawyers did not meet the burden of proof yet.

I think that the prosecution lawyers hasn't met the Birden of Proof yet.They didn't prove that Mae Tuck is guilty because when the defendant lawyers were questioning the constable, they asked him why he arrested Mae. The constable answered that he arrested Mae because she kidnapped Winnie.Then they asked him was he there when Mae kidnapped Winnie. He said no. Then they have no proof.

  4. No because the only ones that know what happen are Winnie,Mae Tuck,Jess Tuck,Myles Tuck, and the stanger but the stanger is dead.

  5. No because the prosecution side missed a great oppurtunity with the constable that they could could've make Mae Tuck look like she was guilty. The defense side is now is doing good defending Mae Tuck.

  6. No, because they didn't prove how Mae Tuck is guilty for kidnapping Winnie Foster. No witness so far said anything that showed that Mae Tuck is guity for kidnapping Winnie Foster.

  8. No, I don't think the prosecuting lawyers have met the burden of proof yet. I don't think they have met it yet because the lawyers only called the Constable and Grandma Foster to the stand. There are a lot more witnesses to call and there is really no proof if Mae Tuck is oinnocent or guilty.

  9. I think that prosecution did not proove that Mae tuck is guilty. The constable said that Mae tuck is guilty but that does not proove how she is guilty of assaulting the stranger. Grandma foster said she thinks that the stranger is a nice man and the tucks kidnapped winnie foster.The defense lawyer asked him, Do you think the stranger is a nice man and she said yes because the stranger said he knows where winnie foster is and grandma foster does not know what the stranger is planing to do with himself and winnie once he gets the forest and finds the spring.

  10. No i don't think the prosecuting lawyers have met the burden of proof.The procecuting lawyers missed their chance to meet the burden of proof when the constable was at the stand.The prosecuting lawyers were unable to prove Mae Tuck is guilty.

  11. No I don not think that the prosecution lawyers have met the burden of poof because it's the beginning of the trial,and they never proved Mae is guilty for assault

  12. No I dont think so they should have more proof, even though the had try but they messed up to make that Mae Tuck didnt do anything. But I know what Mae did was wrong maybe they will get better. I can see that they are doing better

  17. No, because they didn't prove that Mae Tuck is guilty, because the defense made a good point that Mae Tuck is innocent. The prosecution lawyers should have Re- Direct Examination, but they didn't. And I agree with all the jury that the procescution lawyers should have Re- Direct Examination. So that's why the prosecution lawyers didn't prove that Mae Tuck is guilty.

  19. no because this was just the first day of the trial. So we do not have enough proof to say anything yet. We have to continue this trial to find out more.

  22. I think no because Grandma Fosters testomony and the constables testomony proved that they arent sure whether or not Mae Tuck killed the stranger. Also I agree with juror 4 becaus Mae,Jesse,Miles,Mr. Tuck,Winnie know what happened. The prosecuters missed tho most ultimate chance to prove Mae Tuck guilty.
